These Terms of Use (“Terms”) govern your use of the Sommate mobile application operated by Sommate (“we,” “us,” or “our”). By downloading or using the app, you agree to these Terms.

Eligibility

You must be of legal drinking age in your country or region to use Sommate. By creating an account, you confirm that you meet this requirement.

Account Responsibilities

  • You are responsible for maintaining the security of your account credentials
  • You must provide accurate information when creating your account
  • You may not share your account with others or use another person's account
  • You are responsible for all activity that occurs under your account

Acceptable Use

You agree not to:

  • Use the app for any unlawful purpose
  • Upload content that is offensive, misleading, or violates any third-party rights
  • Attempt to reverse-engineer, scrape, or interfere with the app or its backend systems
  • Create multiple accounts to circumvent any usage limits

AI-Generated Content

Sommate uses artificial intelligence to provide wine recommendations, label identification, and food pairing suggestions. You acknowledge that:

  • AI recommendations are for informational and entertainment purposes only
  • We do not guarantee the accuracy of AI-generated wine information, pricing, or availability
  • You should use your own judgment when making purchasing decisions
  • Wine characteristics, vintages, and availability change frequently

Affiliate Links

The app contains links to Wine.com and other third-party retailers. These are affiliate links — if you make a purchase through a link, we may earn a commission at no additional cost to you. We are not responsible for third-party websites, their content, pricing, or fulfillment.

Intellectual Property

All content in the app — including the Sommate name, logo, design, and original text — is owned by us or licensed to us. You may not reproduce, distribute, or create derivative works without our written permission.

Content you create (wine reviews, photos you take) remains yours. By submitting content, you grant us a non-exclusive license to store and display it within the app.

Disclaimers

THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We are not responsible for decisions made based on AI wine recommendations, third-party website content or purchases, or service interruptions or data loss.

Limitation of Liability

To the fullest extent permitted by law, our liability to you for any claim arising from use of the app is limited to the amount you paid us in the 12 months preceding the claim, or $10, whichever is greater.

Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time by contacting matt@sommate.ai.

Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.

Changes to These Terms

We may update these Terms from time to time. Continued use of the app after changes are posted constitutes acceptance of the updated Terms.
